By submitting visual assets (including but not limited to photographs, images, and videos) through this platform, you consent to their use for the development, training, testing, deployment, operation, and improvement of artificial intelligence (AI) and/or machine-learning models, algorithms, and systems. This includes, but is not limited to, the generation of AI outputs, synthetic representations, and derivative works.
You hereby grant DataPlus and its affiliates, successors, licensees, and assigns a worldwide, royalty-free, perpetual, irrevocable, non-exclusive, transferable, and sublicensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, display, and otherwise exploit your submitted visual assets in any and all media or formats, whether now known or hereafter developed.
You waive any right to inspect or approve any finished product or materials that may incorporate your visual assets, and you waive any right to royalties or other compensation arising from or related to the use of your visual assets. You also waive any claims based on rights of publicity, privacy, moral rights, or any similar rights.
You represent and warrant that:
You release and forever discharge DataPlus, its officers, directors, employees, agents, licensees, successors, and assigns from any and all claims, demands, actions, or causes of action that you may have arising out of or in connection with the use of your visual assets as authorized herein.
This consent is designed to protect you as a contributor. By clearly defining the terms of use, it ensures transparency about how your visual assets will be utilized, safeguards your rights, and provides you with a clear understanding of the scope and purpose of your contribution. DataPlus is committed to handling your data responsibly and in accordance with applicable privacy and data protection laws.
Your visual assets and associated data will be processed in accordance with our Privacy Policy and applicable data protection laws. By submitting your visual assets, you acknowledge and consent to such processing.
This Consent, Waiver and Release Form shall be governed by and construed in accordance with applicable laws, without regard to conflicts of law principles.

To participate as a contributor, you must be at least 18 years of age, or if you are between 13 and 18 years of age, you must have obtained verifiable parental or guardian consent. By submitting visual assets, you confirm that you meet these eligibility requirements.

Unless otherwise explicitly agreed in writing, contributions are made on a voluntary basis and no compensation, royalties, or other payments will be due to you for the submission or use of your visual assets.
You retain ownership of your original visual assets. However, by submitting visual assets, you grant the licenses and rights set forth in the Visual Assets Consent, Waiver and Release Form, which you must agree to as a condition of contribution.

We reserve the right to reject, remove, or refuse any submission at our sole discretion. We may also terminate your ability to contribute if we determine that you have violated these Terms and Conditions.
To the fullest extent permitted by applicable law, DataPlus shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your participation as a contributor or the use of your visual assets.
You agree to indemnify, defend, and hold harmless DataPlus and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to your contributions or your breach of these Terms and Conditions.
We reserve the right to modify these Terms and Conditions at any time. Continued participation after such modifications constitutes your acceptance of the updated terms.
These Terms and Conditions shall be governed by and construed in accordance with applicable laws. Any disputes arising under or in connection with these terms shall be resolved through binding arbitration or in the courts of competent jurisdiction, as determined by the applicable dispute resolution provisions.
